Autosense Terms of Service

Eligibility and Accounts

You must be at least 16 years old and reside in the United States to use the Services. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us promptly of any unauthorized access.

App Store and Play Store Terms

If you download the mobile applications from Apple's App Store or Google Play, your use is also subject to the applicable store terms. Apple and Google are not responsible for providing maintenance, support, or warranties for the apps, and they are not liable for claims arising from your use. You must comply with any usage rules or device limitations imposed by the store provider.

License and Use of the Services

Subject to these Terms, we grant you a limited, non-exclusive, revocable, non-transferable license to access and use the Services for your personal, lawful use with vehicles you own or are authorized to manage. You must not reverse engineer, disassemble, or otherwise attempt to derive source code or underlying ideas from the Services.

Prohibited Activities

• Interfering with or disrupting the Services or networks connected to them.
• Using the Services for unlawful, infringing, or harmful purposes.
• Misrepresenting vehicle ownership or accessing vehicle data without proper authorization.
• Uploading malicious code or circumventing security or access controls.
• Misusing AI outputs, including for high-risk decisions without verification by a qualified professional.

Vehicle, Telemetry, and AI Outputs

The Services may collect and display vehicle diagnostics, VIN data, telemetry, and AI generated suggestions. These outputs are for informational purposes only and do not constitute professional mechanical advice. Always validate recommendations before performing maintenance or repairs. You are responsible for complying with applicable laws and ensuring safe vehicle operation.

Fees and Payments

If any portion of the Services is offered for a fee or subscription, you agree to pay the charges disclosed at purchase and authorize us or our payment processor to charge your provided payment method. Fees are non-refundable except as required by law or expressly stated otherwise at the time of sale.

Third-Party Services

The Services may integrate with third parties such as AI providers (e.g., OpenAI), database and hosting platforms (e.g., Supabase/Postgres), analytics, and communication tools. Your use of those services may be subject to their terms, and we are not responsible for third-party content or services.

Ownership

Autosense and its licensors retain all rights, title, and interest in and to the Services, including all intellectual property rights. Except for the limited license granted above, no rights are granted to you.

Termination

We may suspend or terminate your access at any time for violation of these Terms or to protect the Services, users, or the public. Upon termination, your license ends and you must cease use of the Services. Sections that by their nature should survive will remain in effect, including ownership, disclaimers, limitations of liability, indemnity, and governing law.

Disclaimers

The Services are provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and course of dealing. We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components, or that results will meet your requirements.

Limitations of Liability

To the fullest extent permitted by law, Autosense and its officers, directors, employees, and affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill, arising out of or related to your use of the Services. Our aggregate liability for any claim will not exceed the greater of one hundred dollars ($100) or the amounts you paid to use the Services in the three months preceding the claim. Some jurisdictions do not allow certain limitations; the above may not apply to you to the extent prohibited by law.

Indemnification

You agree to indemnify and hold harmless Autosense and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services or violation of these Terms.

Governing Law and Venue

These Terms are governed by the laws of the State of Ohio, without regard to its conflict of laws principles. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Ohio for any dispute arising out of or relating to these Terms or the Services, except where prohibited by applicable law.

Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide notice through the Services or other reasonable means. The "Last updated" date reflects the most recent revisions. Continued use after changes constitutes acceptance of the updated Terms.
